Consumer Health Data Privacy Policy

I. Introduction and Scope

This Consumer Health Data Privacy Policy (this "CHD Policy") describes how EdgeRx Health, LLC, a Wyoming limited liability company with a business address at 1776 Broadway, Suite 2002, New York, NY 10019 ("EdgeRx," "we," "us," or "our"), collects, uses, and discloses "consumer health data" of residents of Washington and Nevada, as that term is defined by the Washington My Health My Data Act and Nevada Senate Bill 370. It applies to the websites, applications, and communications where we indicate that it applies, including edgerx.org (the "Sites").

This CHD Policy supplements the EdgeRx Privacy Policy and applies solely to the consumer health data of Washington and Nevada residents. To the extent this CHD Policy conflicts with the Privacy Policy with respect to that data, this CHD Policy governs.

Consumer health data does not include protected health information governed by the Health Insurance Portability and Accountability Act ("HIPAA"). Information created or maintained by the independent, licensed physicians and affiliated professional entities in the course of treating you is governed by HIPAA and the applicable Notice of Privacy Practices, not by this CHD Policy.

II. Consumer Health Data We Collect

Depending on how you interact with the Sites and with us, the consumer health data we collect may include:

Information that identifies you as seeking health care services, including the conditions, protocols, or treatments you express interest in or inquire about;
Health information you provide before a clinical relationship is formed, such as symptoms, conditions, medications, or health goals you submit through quizzes, forms, or communications;
Information about your health conditions, status, or treatments revealed by your use of the Sites, such as the condition pages you visit and the products you view or purchase;
Inferences about your health drawn from the information above or from non-health information; and
Approximate location derived from your IP address, where it is reasonably capable of indicating an attempt to obtain health services.

III. Sources of Consumer Health Data

We collect consumer health data directly from you, for example when you complete a quiz or form, communicate with us, or make a purchase. We and our service providers also collect it automatically through cookies, pixels, and similar technologies as you use the Sites, as described in Section V of the EdgeRx Privacy Policy. We may also receive it from service providers and partners that help us operate the Sites and deliver our products and services.

IV. How We Use Consumer Health Data

We collect and use consumer health data as necessary to provide the products and services you request, including to:

Operate the Sites and deliver the products and services you request;
Respond to your inquiries and provide customer support;
Detect, prevent, and investigate fraud, security incidents, and other unauthorized or illegal activity; and
Comply with applicable laws and legal process.

Where Washington or Nevada law requires consent to collect or use consumer health data for any purpose beyond providing the products or services you have requested — such as marketing or advertising — we will obtain your consent before that collection or use occurs.

V. How We Disclose Consumer Health Data

We do not share consumer health data with third parties for their own purposes without your consent, and we do not sell consumer health data without a valid authorization signed by you. We may disclose consumer health data:

To service providers that process it on our behalf under contracts that restrict their use of the data, such as hosting, payment, communications, and support providers;
At your direction, to the affiliated professional entities, pharmacies, and laboratories involved in delivering the products and services you request;
To comply with law or legal process, or to protect the rights, property, or safety of EdgeRx, our users, or others;
In connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to applicable law; and
With your consent or at your direction.

VI. Your Rights

Subject to limitations and exceptions in applicable law, Washington and Nevada residents may exercise the following rights with respect to consumer health data:

Confirmation and access. You may confirm whether we collect, share, or sell consumer health data about you, and access that data, including a list of the third parties and affiliates with whom we have shared or sold it and contact information for those third parties.
Withdrawal of consent. You may withdraw any consent you have given to our collection or sharing of your consumer health data.
Deletion. You may request that we delete the consumer health data we have collected about you.

We will not discriminate against you for exercising these rights. We may decline a request where an exception applies, for example where the processing is necessary to prevent, detect, or respond to security incidents or fraud, to preserve the integrity or security of our systems, or to investigate or prosecute illegal activity.

VII. How to Exercise Your Rights

Washington and Nevada residents may exercise these rights by emailing privacy@edgerx.org with the subject line "Consumer Health Data Request." We may take steps to verify your identity before responding, and we will respond within the time required by applicable law.

If we deny your request, we will explain the basis for the denial and how to appeal. You may appeal by replying to our decision; we will inform you of the outcome of your appeal and, where applicable, how to contact the Washington Attorney General or the Nevada Attorney General.

VIII. Changes to This CHD Policy

We may update this CHD Policy from time to time. When we do, we will revise the "Last updated" date above and post the updated version on the Sites. Your continued use of the Sites after an update takes effect constitutes your acceptance of the revised CHD Policy.
